Who we are and what we do:

Settlement Funding of NY will provide pre-settlement funding to plaintiffs anywhere in the US, either directly or through our nationwide affiliate network (see Links below). We fund personal suits (injury, wrongful dismissal, etc.) as well as commercial cases (e.g. expert witnesses) in conjunction with our affiliates nationwide.
Personal Injury
Thousands of Americans are injured every day through no fault of their own. Auto accidents, work place injuries, defective products, and blatant negligence all contribute to the injury of 20 million people annually. Yet even the most favorable case is poor collateral; no bank will lend money to a plaintiff based on the future outcome of a pending lawsuit. And attorneys are ethically prohibited from loaning money or advancing funds to their clients. In other words, you could be the plaintiff in a $250,000 case that will settle in less than a year, yet still be unable to get a dime today. Which may not be a problem if your injury isn't debilitating, if your insurance has covered your medical bills, and if you're able to work. But when a victim is flat on his back and without insurance or income, the passing of every day drives him closer to further tragedy --- the depletion of savings, the loss of his home, financial ruin. Insurance companies are skilled at sensing financial weakness, and they're known to make low-ball offers when they do. Plaintiffs with their backs against the financial wall may not be able to fight for the full settlement they deserve. Often, even a small amount of money can help a victim survive to attain the justice that only sufficient time can make possible. Commercial Litigation
Whatever the commercial "injury" --- breach of contract, patent infringement, illegal business practice --- companies are damaged by other companies every day. The stakes are usually higher than in personal injury cases and the rewards are much greater, but attorneys seldom accept such cases on contingency. That is, the companies are usually required to pay most of their legal bills as the case proceeds. And if the defendant is a much larger company with greater financial resources, the plaintiff is at a serious disadvantage. Without the money needed to fight for three or four years - and with personal expenses, lawyers' fees, the costs involved with expert witness testimony and more - the likelihood of sustaining the lawsuit is small, the odds of winning are remote. These lawsuits are usually much riskier than personal injury cases because they're so much more complex --- and because the amounts of money advanced are so much greater. Nevertheless, the Settlement Funding affiliate network can assist by funding an advance. Without the advance, an attorney may be about to withdraw from a case he knows he could win. Without the advance, the plaintiff could be facing the loss of a business he's spent his lifetime building.
